Property Assessed Clean Energy (PACE) program

If you participated in the residential Property Assessed Clean Energy (PACE) program administered by PACE Funding Group, LLC between January 1, 2018, and August 11, 2020, and ANY of the following applies:

    (1) You were assessed a “contractor fee” by PACE Funding Group, LLC which reduced payment to the contractor to less than the quoted project cost;
    (2) You were charged for a “cool wall coating” product that was not qualified for PACE financing; and/or
    (3) You were charged more than $3.00 per square foot for wall or ceiling insulation.

Then you are a member of a certified class in a class action lawsuit. THIS NOTICE HAS BEEN APPROVED BY THE COURT. ADDITIONAL INFORMATION, INCLUDING THE COURT ORDER CERTIFYING THE CLASS, IS AVAILABLE IN THE IMPORTANT DOCUMENTS SECTION.


On May 4, 2023, the Court certified the case as a class action. If you were over the age of 65 at the time you signed your Open PACE Program Assessment Contract, you may be entitled to additional relief as part of an “elder” subclass.


YOU HAVE THE RIGHT TO OPT OUT OF THE CLASS IF YOU WISH. If you do nothing by July 15, 2024, and you are confirmed/determined to be a member of the class(es), you will remain a class member, you will be represented by Class Counsel, and will be bound by the outcome of the case, regardless of whether the Action resolved in favor of the certified classes or the Cross-Defendants Edwards Builders & Developers, Inc., PACE Funding Group, LLC, and California Statewide Communities Development Authority (“Cross-Defendants”). If you elect to opt out or exclude yourself from the Action, you will have the option to bring or maintain your own lawsuit against Cross-Defendants based on the same challenged practices; however, you will also be required to retain and pay for your own attorney.


You may exclude yourself from the class either by entering an appearance through counsel by July 15, 2024, or mailing in a letter requesting to be excluded from the class. If you send a letter by mail stating that you want to be excluded from the case, the Court will exclude you from the class action (thereby preserving any individual claims you have against the Cross-Defendants). In order for you to be excluded, the letter reflecting your exclusion request must include your name, address, the address where work was performed (if different from your address), telephone number, the date(s) PACE program work was performed, and your signature, postmarked no later than July 15, 2024, to:
